Terms of service

These General Terms and Conditions of RESLIDES GmbH as the seller and you as the customer apply to all orders placed in the RESLIDES online shop (www.reslides.ch) as well as to those purchases for which RESLIDES GmbH declares these General Terms and Conditions to be applicable.

Scope

The terms and conditions apply to all services provided by RESLIDES GmbH in the online shop (www.reslides.ch) and become valid upon conclusion of a contract. The deliveries, services and offers of RESLIDES GmbH are made exclusively on the basis of these General Terms and Conditions, even if they are not expressly agreed again. By sending an order to RESLIDES GmbH, you confirm that you have read these General Terms and Conditions and expressly agree to them.

Conclusion of a contract

All information on goods and prices within the ordering process is subject to change and non-binding. Orders are binding for customers. Accordingly, orders cannot be changed or cancelled. Customers receive a non-binding confirmation from the seller for orders. RESLIDES GmbH may revoke its offer without further notice prior to notification of dispatch, which constitutes the conclusion of the contract with the seller. By placing your order, you confirm that you are aware of the scope and content of your order. Any questions in this regard can therefore be clarified with us in advance.

Delivery

Goods are generally delivered by post or courier. Delivery times in Switzerland are usually 1 to 5 working days, unless otherwise stated for the respective product. This information is provided without guarantee.

If the sender provides an incorrect address or an address where the postal service cannot locate the recipient, the return costs charged by the postal service must be borne by the customer. Once the goods have been handed over to the postal service, RESLIDES GmbH is no longer liable. RESLIDES GmbH therefore does not bear the transport risk.

If, in exceptional cases, an item from the range is not available, we will inform you as soon as possible by email. RESLIDES GmbH reserves the right to make partial deliveries if this appears to be in the interests of efficient processing of the overall delivery. In such cases, no further shipping costs will be charged for the subsequent delivery. In addition, RESLIDES GmbH reserves the right to demand 100% prepayment for international deliveries.

Prices

All prices on www.reslides.ch include the statutory value added tax in Switzerland (currently 8.1%), in Germany 19% and in Austria 20%, and exclude shipping costs. The actual shipping costs are displayed in the shopping cart before the order is completed. RESLIDES GmbH expressly reserves the right to adjust the prices stated online at any time without prior notice and without further explanation. The prices are calculated based on the time of the order on the website.

Shipping costs

Shipping costs are calculated based on the current prices of the postal service at
www.post.ch and any additional costs incurred for packaging.

Terms of payment

The following payment options are available to you:
Purchase on account (POWERPAY)*, PayPal, credit card (via SIX). We also reserve the right to offer advance payment by bank transfer.
For advance payment by bank transfer, the payment period is usually 7 days. If payment is not received within this period, RESLIDES GmbH reserves the right to cancel the order and release the goods for sale again. Any transfer fees are to be borne by you.

*Purchase on account with partial payment option (POWERPAY)
MF Group / POWERPAY, as an external payment service provider, offers the payment method ‘purchase on account’. With the individual invoice, you can easily pay for your online purchase by invoice. If you do not make a payment within the specified time frame, you will receive a monthly invoice with an order overview in the following month.

Upon conclusion of the purchase contract, POWERPAY takes over the invoice claim and handles the corresponding payment modalities. When purchasing on account, you accept the terms and conditions of POWERPAY in addition to our terms and conditions.

Retention of title; offsetting; right of retention
(1) In the case of consumers, we retain title to the purchased item until the invoice amount has been paid in full. If you are an entrepreneur exercising your commercial or self-employed professional activity, a legal entity under public law or a special fund under public law, we reserve title to the purchased item until all outstanding claims arising from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties.
(2) You are only entitled to offset claims if your counterclaims have been legally established or are undisputed or recognised by us. Furthermore, you only have a right of retention if and to the extent that your counterclaim is based on the same contractual relationship.
(3) If the customer is in default of any payment obligations to us, all existing claims shall become due immediately.

Guarantee and warranty

The guarantee for goods complies with generally accepted standards and is valid for 24 months, unless a longer or shorter guarantee period is expressly stated on the delivered goods. Defective goods must be reported in writing to the company address within 10 days of delivery or after the damage has occurred, otherwise the guarantee claim will lapse completely. The warranty claim is valid from the date of delivery. It expires in the event of improper use or natural wear and tear. RESLIDES GmbH reserves the right to decide on a case-by-case basis in the event of a warranty claim.

Minor model deviations

The design of individual items may change slightly. RESLIDES GmbH cannot accept any liability for such modifications made by manufacturers and suppliers.

Care/handling

RESLIDES GmbH accepts no liability for the customer's misconduct in the care and/or handling of the delivered items.

Data protection

RESLIDES GmbH undertakes to process your customer data carefully and to comply with the provisions of the relevant data protection legislation. In particular, no data will be passed on to third parties. However, no liability can be accepted for the security of data transmitted via the Internet.

Marketing

RESLIDES GmbH reserves the right to reuse the email address and telephone number provided when placing an order for its own marketing purposes (newsletters and other communications). You can opt out of this by sending a personal email to support(at)reslides.ch.

Product reviews

RESLIDES GmbH sends automated emails after purchase, asking customers to review the products they have purchased. RESLIDES GmbH reserves the right to use these and all other reviews (without email requests) for marketing purposes.

Vouchers

The voucher is valid for a period of 5 years from the date of issue.

Vouchers can only be redeemed in the online shop at www.reslides.ch and do not apply to any shipping costs.

A voucher can only be redeemed once for a single order. It is not possible to split the voucher value across multiple orders.

Cash payment of the voucher or remaining amounts is excluded, provided this is legally permissible. If a service is no longer available, we reserve the right to refund the voucher value in cash.

Vouchers that have been personalised or already redeemed are excluded from the right of withdrawal.

RESLIDES GmbH accepts no liability for the loss of the voucher, unless the loss was caused by us.

Vouchers may not be reproduced or resold without our consent. In the event of misuse, we reserve the right to block the voucher.

No interest is paid on the credit balance on the voucher.

Personal vouchers that have been created for a specific person or group may not be transferred and may only be redeemed by persons authorised by RESLIDES GmbH.

RESLIDES GmbH reserves the right to cancel all unauthorised orders without comment.

Only one discount code may be used per order.

General liability

It is hereby expressly stated that no liability claims for direct and indirect, immediate and consequential damages, including consequential damages, can be asserted against RESLIDES GmbH by the customer, unless there is intent or gross negligence on the part of RESLIDES GmbH for the damages incurred. For example, damage resulting from accidents, falls, etc. that occur while using RESLIDES GmbH products is your own responsibility.

Amendment of the General Terms and Conditions

RESLIDES GmbH expressly reserves the right to unilaterally amend these General Terms and Conditions at any time without prior notice.

Applicable law/place of jurisdiction

In any case, the relationship between you and RESLIDES GmbH is subject to Swiss law in accordance with the provisions of the Swiss Code of Obligations (CO) and the Swiss Civil Code (CC). The place of jurisdiction is Switzerland. The application of the provisions of the Vienna Sales Convention (‘United Nations Convention on Contracts for the International Sale of Goods’) is expressly excluded.

Severability clause

Should individual provisions of this contract prove to be invalid, this shall not affect the remaining provisions of this agreement. In this case, the invalid provision shall be replaced by a new provision that corresponds to the intended purpose or, if this is not possible, comes as close as possible to it.
